基于系统动力学的企业专利运用法律风险研究

摘    要:结合企业专利运用周期,通过分析企业专利运用过程中风险因素的产生和演化特点,从企业自身实力、专利运用业务流程和国家政策环境三个模块构建系统动力学模型,并采用Vensim PLE软件进行仿真。通过对仿真模型的有效性和灵敏度的验证分析,表明该模型能较好地对企业专利运用过程中的法律风险及企业经济损失演化过程进行拟合,能对企业专利运用策略进行评估,为决策者的策略选择提供理论依据,为企业适用不同环境的专利运用的法律风险提供理论指导。

Research on the Legal Risk of Enterprise Patent Application Based on System Dynamics
Abstract:The legal risk in the process of enterprise patent application has great influence on the enterprise''s patent application, even affecting the enterprise''s destiny. Combined with the cycle of the patents application, according to the analysis of enterprise patent application of generation and evolution characteristics of risk factors in the process of strength, a system dynamics model with module including the enterprise''s own patent strength and the national policy environment, was constructed and simulated by Vensim PLE software. The results is verified by the effectiveness and sensitivity of the simulation model, showing that it can be used to fit the patent legal risk and economic losses of enterprises in the process, can provide a theoretical basis for decision makers to choose strategy and adapt for the different risk environmental.
