| 摘 要： | NGO(Non-Governmental Organization)是一种非赢利性、非政府、自愿自治的正规化民间公益组织,在当代社会具有广阔发展前景。但对NGO工作人员利用职权进行经济犯罪该如何加以规制的问题,理论界和实践中尚无定论,可它却具有极大社会危害性。故全文认为我国刑法典中应设立有关NGO工作人员职务型经济犯罪的规制条款,从犯罪构成要件上将其与公司、企业等赢利组织工作人员和国家公职人员职务经济犯罪进行了详细比较说明。

| Abstract: | NGO is a kind of non-profit,non-governmental and voluntary,autonomous formal group,which has a promising prospect in the modern society.Even though the economic crimes by taking advantage of duty in NGO have bad effects to the society,we don't have an authoritative conclusion in theories and applications on how to deal with the problem.By comparing the elements of economic crimes by taking advantage of duty in NGO with the similar crimes in companies and governments,the article proposes we set up a series of regulation clauses restricting the aforementioned crimes in our criminal code. |
