| 摘 要： | 判决书目标价值的自然正义与其根源于俗世社会的冲突导致了判决书的政治属性。而国际法院的建成背景、法官作为俗世人所固有的缺点和＂秩序法＂的理论共同决定了国际法院的判决书具有政治属性。在国际法院对于柏威夏寺一案的1962年判决和2013年针对先判决解释的两个法律文书中判决书的政治性主要体现在法律语言的准确与模糊、法律推理的严密与松散和法官所附个人意见的避重就轻。应当明确判决书政治性的绝对禁止范畴,以最大限度的实现国际法上的公平正义。

| Abstract: | The conflict between natural justice in verdict target value and the earthly society led to the political nature of verdict.The establishment background of international court,the inherent weaknesses of the judges as secular men,and the theory of Order Law resulted in the political nature of the verdicts of international court.The political nature of the verdict of Preah Vihear Temple Case in the international court in 1962 and the two legal documents explaining the prior verdict was mainly mirrored as accuracy and fuzziness of legal language,tightness and looseness of legal reasoning,and evasion of the judges＇ opinions.It is suggested that the scope of absolute prohibition of the political nature of verdict be made clear to maximize the possible justice under international laws. |
