| 摘 要： | 我国当前人性化执法中存在把人性化执法理解为人情化执法，没有坚持“法律面前人人平等”原则，不执法或降低执法标准等问题，其产生原因主要在于权力本位等陈旧执法理念的影响、实用主义色彩的法律工具主义指导思想。针对这些问题，提出了应采取的相应对策。

| Abstract: | Law enforcement with humanity has been misunderstood as law enforcement with sentiment in current China,the principle of the "equality before the law" was not adhered to,problems of failure of law enforcement or lower standards of law enforcement and other issues,the influence of the outdated concept of law enforcement origenated from power,and the idea regarding laws as tools with pragmatism color,therefore,the corresponding measures should be taken to solve these problems. |
