规制理论视角下的劳动关系探析

摘    要:劳资关系是劳动力市场上一对主要关系,双方不断从自身利益出发进行着博弈,然而由于劳动者的弱势地位,在这种关系中处于不利地位,其自身权益经常受到侵害。主要以劳动关系为研究对象,在规制理论视角下对其进行了分析,并探析政府规制在劳动关系中的作用和存在的问题,并提出了若干政策建议。

Abstract:The relationship between employee and employer is one major pair relation in the labor market. Both sides are gambling unceasingly for their own benefit. But the employee is in an inferior position in this kind of relationshipbecause of his weak power,and his own rights and interests are often violated. This paper mainly takes the relationship as the object of study,then analyses it from the angle of regulation theory,tries to find out the roles and the existing problems in the laboring relationship of government regulation, and puts forward some proposals.
