| 摘 要： | 电子合同是一种特殊的合同形式,其主体、缔约与技术支持均不同于一般买卖合同。文章以明晰电子合同的概念为起点,分析电子合同的特点,指出实践中电子合同形式的认定原则以及司法实践中电子合同订立与成立中的问题,并在最后提出强调功能等同原则以及加大电子合同技术层面立法的建议。

| Abstract: | E-contract is a special form of contract,whose subject,contracting and technical support are all different from general sales contracts. Starting from explaining the concept of E-contract,this paper analyzes E-contracts＇ characteristics and points out the principles identified in practice and issues in E-contract signing and founding in judicial practices,emphasizes the principle of functional equivalence and makes legislative proposals to enlarge technical aspects of E-contracts as well. |
