| 摘 要： | 我国司法审判权制度移植自西方国家,但受到我国传统体制等诸多因素的影响,我国司法审判权在运行过程中存在诸多异化现象。这些异化现象既影响了审判机制解决纠纷功能的发挥,降低了审判效率,又制造了新的司法不公,影响社会和谐。笔者认为应在充分认识审判权性质的基础上,坚持审判权的中立性、独立性、正当性和被动性,科学构建我国审判权的运行机制,使我国的司法审判权逐步形成独立、公正、效率等品格,为司法审判权运行进入正常轨道提供必要的制度支持。

| Abstract: | The judicial power system in China was transplanted from western countries.But influenced by factors such as China’s traditional systems,there is much Alienation over its operation.The alienation not only affects the function of judicial mechanism to resolve disputes and reduces the efficiency of the trial,but also created a new judicial injustice that affect social harmony.We believe that,based on the full awareness of the nature of judicial power,we should adhere to neutrality,independence, legitimacy and passiveness of judicial power and scientifically construct an operation mechanism in China to gradually form the characters of independence,impartiality,efficiency,etc.in jurisdiction operation and provide necessary institutional support for its normal operation. |
