| 摘 要： | 我国目前正处于腐败犯罪的高发期和多发期,为应对严重的腐败犯罪态势,应充分发挥刑事政策在预防和惩治腐败犯罪方面的积极作用.为此需构建防治腐败犯罪三层级的刑事政策体系,包括总刑事政策、基本刑事政策以及具体刑事政策.防治腐败犯罪的总刑事政策以社会治安综合治理为主,防治腐败犯罪的基本刑事政策为宽严相济刑事政策,而坚持腐败行为的适度犯罪化以及“抓大放小”则属于防治腐败犯罪具体刑事政策中的重要内容.为构建科学的防治腐败犯罪刑事政策体系,更好地实现预防与惩治腐败犯罪的目标,我国还需设立负责反腐败工作的专门机构.

| Abstract: | China is suffering from more and more corruption crimes. In response to the serious corruption crime situ- ation in our country, the criminal policy should give full play to the positive role in prevention and punishment of cor- ruption crime. Our country should build the three levels of criminal policy system, including general criminal policy, basic criminal poliey and specific criminal policy. Specifically, the general criminal policy is the policy of social se- curity comprehensive management, the basic criminal policy is the policy of tempering justice with mercy; and mod- erate incrimination and invigorating large crimes while relaxing control over small ones are the important content in the specific criminal policy. In order to build a scientific system of criminal policy, our country should set up special- ized ageneies responsible for anti-corruption work. |
