| 摘 要： | 信托是指受托人接受委托人的委托，为受益人的利益或某种特定目的，对于委托人委托的财产权进行管理和处分。信托法律关系涉及三方当事人，是围绕着一定财产而发生的，以信任为基础的法律关系；是财产上的所有权和其利益相分离的一种法律关系，信托和代理，监护和行纪等民事法律制度有着明显的区别。
