| 摘 要： | 在世界航运市场上，船舶抵押对于资金匮缺的船东不失为一种以船舶作为担保而取得贷款的有效融资手段。笔者试图探讨有关船舶抵押的法律和实务，并讨论船舶抵押权的有效设定、共有船舶的抵押、抵押船舶的保险、抵押权人违约时抵押权人的救济办法、抵押船舶经司法变卖后债权人之间的受偿顺序，以及抵押船舶真实船东身份的认定等法律问题。

| Abstract: | Ship mortgage as an efficient means of financing for undercapitalized shipowners is widely used as security for loan in tile world shipping market. This articale purports to discuss laws and regulations as well as the practice in this respect and make some comments on certain legal issues in relation to its creation, mortgage on the ship owned by joint owners, its insurance, the mortgagee's. remedies when the mortgagor is in default and the prioritics among the debtors after the mortgaged vessel is subject to the forced sale by the court and the identification of the true owners of the mortgaged vessel. |
