| 摘 要： | 法治有形式意义的法治与实质意义的法治之分,形式意义的法治只强调“有法可依,有法必依”而实质意义的法治除强调应“有法可依,有法必依”外,还突出强调所依之法必须为好法。好法必须是有利于维护社会的稳定、有利于生产力水平的提高、有利于人权的保护,否则即为坏法。在判断好法、坏法时,这三个标准缺一不可。要制定出好法,最根本的是在立法工作中坚持实事求是,坚持走群众路线。“恶法非法”论在实践中是有害的。

On the Right Viewpoint of Rule by Law |

| Abstract: | The author thinks there are two kinds of meaning about "rule by law",the one is formal meaning of it,and the other is substantial meaning of it.The author thinks we must take the latter, namely the substantial meaning of "rule by good law" in our country. The author also pointed out what is the criterion to evaluate the good law and how to make the good law. |
