| 摘 要： | 我国检察权的本质属性是法律监督性。这种本质属性通过我国检察机关的一般性质、工作内容以及工作方式表现出来。从检察权概念的学术争议与检察权体现的司法属性来看,检察权应承担司法职能。在提倡检察机关直接参与社会管理活动、化解社会矛盾的政治背景下,重新审视因各种原因导致检察权的行政化倾向和司法职能弱化,正确理解检察机关的地位和作用,在社会管理中充分发挥检察权的司法功能,才能实现用检察权创新管理社会。检察权的配置与运行本是司法活动中至关重要的一环,它深深的关系到社会管理的衔接与流畅,如果在社会管理活动中弱化或者忽视其司法职能,那必然是一种资源的浪费和路径的损失。

| Abstract: | The prosecutorial power＇s essential attribute of our country is legal supervision. This essential attribute can be showed through the character, job contents and working mode of prosecutorial organs. From the view point of the prosecutorial powers academic controversies and judicial character showed by the prosecutorial power, prosecutorial organs should take judicial powers. Under the political background of encouraging prosecutorial organs to join in social management and conflict resolve, it is necessary to look again at the elements which cause the administrative trend of prosecu- torial power and reduction of judicial functions. Therefore, it is necessary to understand the function and position of prosecutorial organs, and fully develop its judicial functions to innovate managing the society in prosecutorial power. The ar- rangement and operation of prosecutorial power should be a necessary part of judicial act, which is related to the fluency and coherence of social management. Ignoring and redacting its judicial functions is restores wasting and path lose. |
