我国发展房地产投资信托的法律障碍与对策

摘    要:随着银行对房地产信贷条件的收紧,房地产开发迫切要求开拓新的融资渠道。同时,民间资本的扩大需要寻找合适的投资渠道。集房地产市场和资本市场于一身的房地产投资信托迅速发展成为新的房地产融资方式。但是相关法律制度的缺失或不健全给我国发展带来了障碍。我国迫切需要创新法律制度,寻找解决这些障碍的对策,为促进房地产投资信托的发展奠定坚实的法律基础。

The Legal Obstacles and Solutions to Development of REITs in China

Abstract:With the intensity of the real estate loan from the bank, the real estate eagerly needs to explore new ways to finance. At the same time, the expansion of the folk capital needs to fred suitable ways to invest. REITs which combines the real estate market and the capital market together, has quickly become the new way of the real estate finance. However, the lack or imperfect of the related legal system bring obstacles to develop REITs in China. We need to innovate the legal system, and find out the way to deal with these obstacles, and settle the solid legal base to stimulate the development of REITs.
