| 摘 要： | 在应对紧急状态时,必然要运用行政紧急权力。把行政紧急权力纳入法治化的程序控制是一种有效途径。各有关国家行政紧急权力的程序立法大体分两种模式。我国行政紧急权力的程序制度应当在克服原有程序缺陷,权衡公开、公正、效率等因素基础上,加以合理设计。

| Abstract: | When dealing with the emergencies,it is necessary for administrative institutions to exercise administrative emergent power.Since this power has theoretical basis on rule of law,it should be controlled by law-ruled procedure.The procedural legislations of administrative emergent power in various countries concerned can be generally divided into two patterns.By overcoming these flaws which the original procedure has and weighing such factors as publicity,fairness and efficiency and etc.,China should frame the procedural systems of administrative emergent power reasonably. |
