| 摘 要： | 先秦时期,是中国古代法律思想史上的一个重要时期,这一时期百家争鸣的特色使得多种法律思想在激烈交锋中相互发展,而作为争论焦点的"人性论",则为人们提供了一个了解那一时期法律思想的切入点.本文阐述了当时最具代表性的儒家、法家、道家和墨家对于人性论的不同观点,并进而分析了人性论对先秦及我国古代法律思想发展所产生的重要影响.

| Abstract: | The Pre-Qin period is a significant period in the history of Chinese ancient legal thoughts.The development of different legal thoughts was attributed to the fierce argument among them in the freedom age of speech.The focus on the argument of humannature thoery provides a breakthrough point to learn the legal thoughts during that period.This article interprets the typical different points of the Confucianists',the Legalists',the Taoist's and the Mohist's,on the basis of which the article comments on the effect of humannature thoery on the development of legal thoughts. |
