摘    要:劳务派遣制用工在我国正呈现迅速扩大之势,但是当前我国劳务派遣用工存在劳务派遣用工扩大化、被派遣劳动者权益受侵害、发挥工会作用的体制不完善等问题。因此,政府应从源头上切实加强对劳务派遣机构的管理和监督;对于用工单位而言,则需调整相应对策,优化业务模式以减少劳务派遣用工数量,同时又要积极维护被派遣劳动者的合法权益,将雇员的利益放在第一位,实现企业与雇员的双赢。

Abstract:The rapid expansion of labor-dispatch employment in China resulted in a series of problems such as the overemployment of dispatched labors, the infringement of their rights and interests,and the imperfect system inhabiting trade unions to fully exert their influence. To tackle these problems,the government should reinforce its supervision and administration over labor dispatching institutions whereas the enterprises accepting the dispatched labors should strive to optimize their modes of operation so that the number of dispatched labors will decrease and the legitimate rights and interests of the dispatched labors can be protected.
