| 摘 要： | 随着城市化进程的发展，国家时农村集体土地征收是不可逆转的趋势，土地经征收转换为国有土地，农民既失去赖以生存的土地，也有可能会侵犯其合法权益。文章结合我国目前征地立法现状，对公共利益进行程序性分析，重构在地救济机制，最后对失地农民的社会保障制度提出建议。

| Abstract: | With the development of urbanization, the rural collective lands are to be expropriated by government. After expropriation private lands became the national lands. Peasants, who lost their lands, may be violated with their legal rights. The communal interest is analyzed combined with current legislation to reconstruct the aiding system. |
