| 摘 要： | 我国海商法追偿时效的第二个起算点在海事司法实践中碰到了诸多问题,对此理论界存在着“存”、“废”之争。本文通过比较研究和法意解释,主张在对第二个起算点保留的基础上进行有益的改进,并为此提出了立法建议。

| Abstract: | There exist many problems in respect of the second counting point of the limitation period of recourse claim of CMC in maritime justice practice, and the circle of theory has the controversy whether it should be abolished or not. Through comparative research and explanation of the meaning of law, this paper proposes the beneficial mend to the second counting point on the basis of reserving it, and puts forward the suggestion of legislation. |
