| 摘 要： | 传统的环境法是由自然资源 (包括能源 )法、污染防治法、自然保护法三个不同的法域组成的部门法 ,三个法域各自着眼点并不相同 ,以至于难以形成环境保护的合力。资源保护、污染防治以及自然保护对公益衡平的价值追求和对环境保全的共同目标追求使得现代环境法形成统一的精神成为可能。这种精神应是 :在考虑到环境承载力的前提下 ,实现人类的可持续发展。
