| 摘 要： | 别居制度是指在保持婚姻关系的前提下,男女双方在一定期间解除合同居义务的法律制度。在《婚姻法》中增设别居制度是对夫妻同居义务规定的补充,有利于完善破裂主义离婚立法,可弥补调制制度的不足,也有利于社会稳定。

| Abstract: | Separation system refers to the legal system in which both sides of man and wife dissolve cohabitation obligation in a certain period of time proided that they maintain the marital relation. Separation system should be added to our "marriage law". To establish separation system is a supple-ment to the regulations of cohabitation obligation between man and wife. It will help perfect divorce legislation of rupturism, compensate the defects of conciliation system, and also benefit the social stability. |
