| 摘 要： | 我国刑事诉讼法虽赋予了律师一定的诉讼权利，但其在侦查阶段仅仅只能为犯罪嫌疑人提供法律帮助，难以真正担当维护犯罪嫌疑人合法权益之责任。因而，从法律上赋予律师在侦查阶段的辩护人地位及相应的诉讼权利，对于推进刑事司法改革，实现司法公正具有现实意义。

| Abstract: | China＇ s criminal procedural law gives lawers certain procedural rights, but in the process of investigation they can only provide legal help for the suspects, which cannot really protect the legal rights of suspects. So, it is very important for the judicial reform to give lawers the positon and right in the process of investigation. |
