| 摘 要： | 单位犯罪刑罚理念是单位犯罪刑罚制度设计的基础。长期以来，我国单位犯罪刑罚理念基于残缺的客观说，严重影响了刑罚效果的发挥。应该提倡基于主观说的客观主义的单位犯罪刑罚理念。刑罚不仅仅是社会基于道义施加的行为强制，更应从受刑主体角度考察其实际刑罚效果，从而达到一般预防和特别预防的统一。

| Abstract: | The concept of unit crime penalty is the basis on which unit the crime penal system is designed. For a long time, China＇s concept of unit crime penalty is based on incomplete objectivity, which seriously affects the effectiveness of penalty. Therefore, the objectivism in unit crime penalty should be advocated based on the concept of subjectivity. The penalty is not only the mandatory imposed on the basis of morality by society, but it should also be inspected by the actual effect, so as to achieve the unity of the general prevention and especially prevention of crimes. |
