| 摘 要： | 驰名商标保护的理论基础问题，是研究从何种理论角度出发，来更有力地保护商标权人和消费者的合法权益，维护市场竞争的正常秩序。各国对驰名商标予以特殊保护的三种理论基础（混淆理论、反淡化理论和不当得利理论），建立反淡化理论是当前世界驰名商标立法的趋势，应在我国建立反淡化理论以进一步完善我国驰名商标保护的法律制度。

| Abstract: | The theory base of protection of well-known trademark is the problem that how to protect the persons of trade mark and consumers strongly,and to sustain the order of market contest,through analyzing which theory angle.At first the thesis illustrates several theory bases of protection of well-known trademark in the world(ie,the theories of confusion,of anti-dillution,of unjust enrichment),the thesis indicates that constructing the theory of anti-dillution is a tendency of international legislation of well-known trademark protection at present.And at last put forward to constructing the theory of anti-dillution to perfect the legislation on protection of well-known trademark in our country. |
