| 摘 要： | 有效遏制当前不正常的行政权力运行,体现了权力运行制约机制建设的必要性和迫切性。笔者针对行政权力运行中存在的以下四方面的道德问题:权力运行的范围过大;权力运行的手段不正当;权力行使不能正确到位;权力行使的目的错误,指出以道德机制来制约权力运行的重要功能。而道德机制制约的重点是行政权力运行的实际主体,对此提出了建立权力运行道德保障机制的总体思路和基本要求:(1)行政权力运行的道德保障要求;(2)提高权力运行道德保障能力的基本途径,以促使权力主体循善而为。

| Abstract: | How to effectively contain the abnormal administrative power operation at present highlights the necessity and emergency of the construction of the restraint mechanism of power operation.Aiming at the moral problems existing in administrative power operation,such as the too extensive scope and the improper means of power operation as well as the failure and wrong goal of power exercising,this article points out the important function of moral mechanism to restrain the exercising of power.What the moral mechanism restrains is the actual body of administrative power operation.As for this,the article puts forward the general idea and basic requirements of building moral guarantee mechanism of power operation: first,the moral guarantee requirements of administrative power operation;second,the fundamental means of promoting the moral guarantee capability of administrative power operation so as to ensure the power subject to carry out its functions properly. |
