| 摘 要： | 当代中国刑法强化了人权保障机能。人权保障的思想也成为当代刑法的鲜明主题之一。当代刑法在罪刑法定、打击侵犯人权的各种犯罪、有利被告原则、正当防卫制度的建立以及刑罚的人性化等方面无不闪耀着人权保障的光芒。但在刑法宪法化、刑法的观念层次、慎重适用死刑、正当防卫制度的完善以及现代保安处分制度的确立等方面尚需完善，以便更好地闪耀当代刑法的人性光辉。

| Abstract: | Contemporary China's criminal law has strengthened the function of the ensured human rights.The thought of the ensured human rights becomes one of the distinctive themes of contemporary criminal law too.The contemporary criminal law glitters the brilliant rays in some aspects,such as sentencing legal crime,attacking various kinds crimes of infringing human rights,establishing the favorable defendant's principle,self-defense of system and humanization of penalty.But there are still some respects that need to be perfected,that is,the criminal law constitution,the ideal level of criminal law,death penalty applied to cautiously,the perfection of the self-defense system and the establishing of the modern security measures system,etc.so that we can better glare the human nature glory of Contemporary criminal law. |
