| 摘 要： | 近代中日两国都经历了学习西方先进法制的过程,但两国的学习效果却相差悬殊。日本学习西方要早于中国,且由于进行了明治维新,使得日本学习了中国一千多年之后,转向西方学习西方的先进理念与技术,在教育立法领域远超中国。中国在很大程度上是学习日本的,这也为中国教育立法走符合自己的道路提供了借鉴意义。
