| 摘 要： | 在法律的层面上,公民环境权是宪法和行政法上的权利,实质上是一种请求权;企业环境资源使用权既可以是民法上的物权,也可以是行政法上的请求权,二者之间是对立统一的关系。公民享有环境权有利于遏制企业滥用环境资源使用权,有利于实现人与自然的和谐。协调公民环境权与企业环境资源使用权的矛盾应当坚持一般利益优于特殊利益并兼顾特殊利益的原则,平等保护原则,利益权衡原则。

| Abstract: | In the legal respect, there is a dialectical relation between citizen environmental right, which is essentially a plead in constitutional and administrative law, and enterprises environment resources use right, which is both a real right in civil law and a plead in administrative law. The fact that citizens enjoy the environmental right can be used against the abuse of environmental resources use right by enterprises and it can benefit the harmony of man and nature. Equal principle, interest balancing principle as well as the principle of giving more consideration to general interests than to special interests while paying proper attention to the latter should be applied in dealing with the contradiction between citizen environmental right and enterprise environmental resources use right. |
