| 摘 要： | 《联合国打击跨国有组织犯罪公约》是第55届联合国大会第62次全体会议于2000年11月15日通过 的。公约产生于深刻的政治、经济、法律和技术背景之下。公约对一些刑事司法的重要概念进行了界定,确立了 “主权原则”等一系列重要原则,在机制上进行了很多创新,还规定了有关“取证”、“没收和扣押财产”等刑事诉讼 程序,是一部刑事实体法和诉讼法都有所兼顾的国际文书。公约旨在建立一个遏制跨国有组织犯罪的全球性综合 法律机制。它是国际刑事司法合作发展史上一座新的里程碑。

| Abstract: | The Convention evolves from the deeply political, economical, legal and technological background.Some important concept relating to the criminal administration of justice have been defined , a series of important principles , such as ' the principle with sovereign right ' have been established, a lot of innovation on mechanisms have been carried on. Also ,some criminal procedure laws such as "collecting evidence", "confiscating and detaining property" have been stipulated. To some extent, it is the international document that combine criminal substantive law with criminal procedure law. The convention aims at setting up a comprehensive legal mechanism of globalism of combating the transnational organized crime. It is a new milestone in the history of cooperative development among the international criminal judiciature. |
