| 摘 要： | 格式条款合同作为规模经济和专业经济的产物，大大地加速了交易的速度，降低了交易的成本，但随着其不断的应用和市场经济的发展，格式条款合同的效力出现了争议，并且逐渐显露出一些弊端，本文就格式条款合同的概念、特征以及效力的认定进行了阐述，指出了目前中国格式条款合同使用中存在的一些问题，并提出了对其进一步加以完善的措施。

| Abstract: | Standard article contract is the result of dimensional economy and specialized economy , which improve greatly speed of trade and reduce costs of trade. However, with application of standard article contract and development of market economy, the efficacy of standard article contract has some disputes, and appears gradually some problems. So this article clarifies the concept, characteristics and efficacy affirm of standard article contract, pointing out some present problems in china ,and advising some measures to perfect it. |
