| 摘 要： | 高校学生管理权具有双重属性：既表现为一种管理权力又表现为一种管理权利。高校管理权与学生权利的关系，实质包含两类矛盾关系：高校管理权力与学生权利的关系和高校管理权利与学生权利的关系。建构高校管理权与学生权利的平衡机制，就是要实现前述两类矛盾关系的平衡：高校管理权力与学生权利的平衡；高校管理权利与学生权利的平衡。
