| 摘 要： | 我国婚姻法关于夫妻共同财产制存在着制度性缺陷,在考察了知识产品生产过程的基础上,依据夫妻共同财产制的理论,提出完善夫妻共同财产制的基本设想:确立知识产品的概念,并将知识产品纳入夫妻共同财产范围;针对知识产品这种无形财产的非物质性和不可分割的特点,提出以推定分割法来解决离婚诉讼中知识产品的分割问题。

| Abstract: | After the exposition of conception and character concerning intangible Property (knowledge products),the article advanced that there are drawbacks in Joint Property System of Marriage in Chinese Marriage Law.And after the investigation into the gain of intangible property,that is production process of knowledge products and theoretical foundation of Joint Property System of Marriage,the article advanced the basic assumption of perfecting Joint PropertySystem of Marriage:define the conception of knowledge products and include them in Joint Property System of Marriage.Furthermore,in the light of intangible property(knowledge products) which is not the materiality and in acienable,the article also advanced a way of inferring to some the cutting apart problem concerning intangible property in the suit for divorce. |
