| 摘 要： | 《教育法》规定任何纽织和个人不得以营利为目的举办学校及其他教育机构，《民办教育促进法》规定出资人可以从办学结余中取得合理回报，一方面国家鼓励民办教育的发展，另一方面又受到利益的限制，如何认识民办教育公益性与盈利性的关系是我国教育法制建设和民办教育实践中亟待解决的基本认识问题。

| Abstract: | Education Law provides that any organization or individual snail not be allowed to hold schools and other educationalinstitutions for profit-making purpose.＂Private Education Law＂ provides investors to take a reasonable return from schools. On the one hand,the country encourages investors develop private education, and on the other hand, it sets restrictions in earning interests, how to understand the relationship between profitability and non- profitability of private education is a basic problem in constructing China＇s education law. |
