| 摘 要： | 从医患关系是调整平等主体之间的人身权和财产权的民事法律关系入手 ,可认为医患关系属于民事法律关系中的合同关系 ,属技术服务合同的范畴 ,具有要式、双务、有偿的特点 ,较之普通的合同 ,有缔约的强制性、医方承诺与履行的及时性、内容的相对不确定性、合同的延续性、医疗诊治行为有一定加害性、合同履行的风险性等特殊性。

| Abstract: | Patient-hospital relation is a civil law relation that deals with the right of person and the property right of different equal parties.It can be regarded as a solicitation-acceptance technical service contract in which both parties should carry out some commitments and the service should be paid.Compared with common contract,it has the following particularities:1)It is a compulsory contract.2)The hospital should commit itself to timely medical service and carry it out.3)The content of the contract is relatively uncertain.4)The hospital has to take postcontract responsibility.5)The hospital's medical treatment itself is a potential harm to the patient.6)The treatment risk is great. |
