摘 要: | 新颁布的《物权法》第106条明确规定了不动产的善意取得制度,突破了我国传统法律理论对善意取得仅适用于动产的限制。从不动产善意取得的法理基础、现实意义以及法律适用等多个角度阐述了对该制度的看法。

Abstract: | The 106th article of the newly decreed Real Rights Law definitely defines the acquisition of real estate in good faith, which breaks the restraint that the traditional legal theories of the acquisition in good faith only applies to personal property. This paper expounds upon views towards the system of the acquisition of real estate in good faith from angles of legal theory foundation, realistic significance and legal application. |
