| 摘 要： | 在论述民间文学艺术保护必要性的基础上，分析民间文学艺术版权保护模式的合理性。主张在我国通过特殊版权保护模式实现对民间文学艺术的保护。在特殊版权制度的构建中应重点解决民间文学艺术权利主体、权利客体、保护期限、使用许可制度等几方面问题。

| Abstract: | It discusses the necessity of protecting the folklore, analyses the rationality of the folklore of the copyright protection mode, and claims to protect it by special copyright protection mode. In the construction of special copyright regime, we should focus on the subject of right of the folklore, the object of right, the duration of protection, and the license system ect. |
