| 摘 要： | 网络在传播信息的同时也对人类现有的法律制度构成了挑战。由于网络上传播的大量信息是著作权保护的客体,所以著作权制度受到网络最为强烈的冲击,著作权制度正在网络环境下经历必要的调整。本文从网络作品著作权归属入手,在明确网络著作权的"法定许可"和"合理使用"的基础上,阐明对网络作品的侵权责任,并建议建立著作权的集体管理制度以解决网络作品著作权纠纷。

| Abstract: | The net forms a challenge to the legal system of the human beings,meanwhile it spreads the information.Because most of information spreading through the net are bodies of copyright,the copyright system is attacked strongly by net and it is experiencing an necessary regulation under the net environment.This article studies the belonging of net works copyright and clarifies the responsibility of copyright infringement by understanding the legal permission and reasonable utiluzation of the net copyright.It suggests also to set up the collective managing system of copyright in order to solve disputes of net works copyright. |
