教育法的价值探析

摘    要:教育法的价值问题是教育法的基础理论问题,但长期以来并未引起学界应有的重视。对教育法的价值进行分析和研究,应以价值哲学与法哲学的原理为基础和依据。教育法的价值可分为终极价值、核心价值、一般价值三个层次,它们分别是公民受教育权、政府责任、教育秩序与自由。

Abstract:The value which is the basic theory of the education law, has not caught much attention from the acadmic circles for quite a long time. It should be based on the value philosophy and law philosophy to analyze and research the value of education law, which is divided into three levels: ultimate value, core value and general value, and respectively for the civil education right, government responsibility, educational order and freedom.
