| 摘 要： | 我国现行《继承法》由于立法之初的局限性,导致在遗嘱继承制度设计上存在许多缺陷与不足。我们应当以《民法典》的制定为契机,从遗嘱的形式及其效力、遗嘱内容、遗嘱能力、特留份制度和遗嘱执行人制度等几个方面对现行遗嘱继承制度加以修订,完善遗嘱的形式要件和效力规则,增加关于遗嘱内容的原则性规定,明确遗嘱能力的界定标准,确认和建立特留份制度。

| Abstract: | The limitations of the current ＂Inheritance Law＂ resuh in several deficiencies and defects in the establishment of Inheritance System in China. In order to seize the opportunity of establishing Civil Law and further perfect the inheritance system in China, the current inheritance system should be amended from the following aspects, i.e. will＇s form and validity, content, competence to testament, the system of special share and the system of executor of will, etc. |
