| 摘 要： | 陈傅良是宋代著名的永嘉学派巨擘,对法制本质以及立法、变法、司法做过许多思考和探索.其中,最具特色和智慧的是追求法制的公正公平,不仅是立法的,而且是司法的,尤其"行法自贵近始";重视司法的求实重人,强调法律运用的恰当准确以及事实认定的真实有效,并且要求充分发挥司法主体的主观能动性,也就是"原情定罪"、"司法在人".把重法与重人结合起来,实现法制公正公平的终极目标.陈傅良的法制思想不仅具有一定的时代先进性,还有强烈的历史借鉴性.

| Abstract: | Chen Fuliang is one of the masters of Yongjia School in the Song Dynasty who did a lot in legal nature,legislation,reform and judicature.The most striking characteristic is that justice lies in legislation and judicature,appropriate manipulation and valid facts,subjective initiative of combining law and human,which is the terminal goal of law.His ideas are of certain modernity and historical reference. |
