| 摘 要： | 2005年，最高人民法院发布了《二五改革纲要》，明确提出建立和完善案例指导制度。鉴于案例指导制度具有弥补立法的不足，制约自由裁量权，促进司法和执法统一的作用，各级政府部门纷纷效仿，在本辖区内积极探索建立案例指导制度，指导本部门的行政执法工作。然而，各地建立的案例指导制度存在不统一、不规范的现象，因此探讨行政指导性案例概念、名称、效力、发布主体等问题，具有重要意义。

| Abstract: | In 2005, the Supreme People＇s Court issued the 25 reform outline, clearly proposed the establishment and perfection of cases guiding system. In view of cases guiding system will make up for the inadequacy of the legislation, restricting the discretion to pro- mote unity of the judicial and law enforcement. Since then, government departments at all levels have also followed suit, actively explore the ease studies guidance in this area, and guide the work of the Department of administrative law enforcement. So all over the building of eases guiding system inconsistent, irregular, case concept, name, force guiding the discussion on administrative, publishing and other is- sues, is of great significance. |
