| 摘 要： | 当前,中国正在进行着一场深刻的法治现代化革命,在这场法治现代化进程中,如何客观、公正地对待传统法律文化显的尤为重要。中国传统法律文化表现为宗法等级、皇权至上、法律工具主义、对个人权利漠视等明显不符合现代法治精神的内容,这就需要重塑与现代法治相符的现代法律文化,即对权力制约的同时保护公民个人权利,塑造现代公民人格。当然,在法治现代化过程中,同时要重视对传统法律文化的吸收,利用传统法律文化的固有载体来表达现代法治的内在要求。

| Abstract: | Presently,China is carrying on a profound revolution of government under the of law.In this process,how to objectively,fairly treats the traditional legal culture is important.The Chinese tradition legal culture performs as the clan-law rank,the imperial authority and the law instrumentalism as well as ignore of individual rights which do not conform to the requirement of government under the rule of law in modern sociaty.Therefore,it needs us to remold the modern legal culture which tallies with the government by law,namely,the power of check&balance while the protection of individual's civil rights and mold of modern citizen personality.Obviously,in the process of government under the rule of law,we must take advantage of the traditonal legal culture to express the instrinsic request of government under the rule of law. |
