| 摘 要： | 正确处理土地征收中公共利益与个人利益的关系是促进国家经济建设、维护农民合法权益、保证社会安定与和谐发展的重要基础。在土地征收中，公共利益与个人利益二者之间的矛盾主要表现为征地范围过宽、补偿偏低、安置不当，其原因为“公共利益”界定不明、集体土地产权缺陷、政府权力寻租和政府行为缺乏规范。正确处理二者关系应从严格界定公共利益、完善集体土地产权制度、完善征地补偿机制和妥善安置失地农民着手。
