| 摘 要： | 隐名代理的发生除了代理权必须真实存在这一条件外 ,还须要借助普通法通过判例所确立的两项权利即本人的介入权和第三人的选择权。我国《合同法》所规范的介入权和选择权实际上是借鉴了《国际货物销售代理公约》和《欧洲合同法原则》的有关规定 ,只是为这种代理关系下所发生纠纷解决做出了符合现实的设计。
