| 摘 要： | 中国高等教育立法在立法形式和立法内容方面反映出诸多质量问题：从纵向结构看，上位法与下位法之间的衔接不足，下位法不到位甚至缺位，影响法制的协调有序；从横向结构看，高等教育法律关系中的主体身份不平等，客体立法不全面，有损法制的完整统一；从实体性内容看，权责的关系仍不一致，与宪法、行政法和民法的基本原则有不符之处；而程序性内容不仅在数量大少于实体性内容，程序性法律规范的可行性和合理性也存在着相当的不足。产生上述质量缺陷的主观因素：一是对高等教育的发展规律把握不到位；二是法制观念的偏差导致高等教育立法的价值取向的偏差。

| Abstract: | There are quite a few problems of China's legislation in higher education from two aspects of lawmaking's form and content.As to its horizontal structure,some laws on a lower level are deficient,even absent,which not coordinated with those on higher level.As to its vertical structure,the statuses of legal subjects in higher education are unequal,and it is also lacking of some regulations on legal objects.In terms of substantive laws,it is not completely adapt to the principles of constitution,administrative law and the civil law,because of the inconsistency between rights and responsibilities,powers and obligations.In addition,the procedural laws are not only much less than substantive laws in quantity,but their feasibility and rationality are deficiency.Furthermore,two subjective reasons are analyzed: the one is ambiguous cognition on the developmental regulation of China's higher education;the other is misunderstanding on concept of rule of law leading to the wrong tendency of lawmaking value. |
