| 摘 要： | 一些学者认为非物质文化遗产与地理标志都是自然因素和人文因素的产物,他们之间存在着高度契合性,地理标志的权利共有性、地域性、无期限性构成了非物质文化遗产地理标志保护的特色,地理标志是非物质文化遗产的最佳保护模式.但从地理标志的客体、构成及其本质特征来看,这些特色恰恰是地理标志保护非物质文化遗产的障碍所在,非物质文化遗产采用地理标志保护模式并不可行.

| Abstract: | Some scholars argue that the geographical indications and intangible cultural heritage are the outcome of natural elements and human factors. There exists the corresponding nature between them. The features of geographical indications such as regionalism, co - ownership and permanent of right constitute characteristics of the geographical indications protecting intangible cultural heritage and so it is the best model of protecting intangible cultural heritage, however an analysis of features of the geographical indications shows that these characteristics are obstacles of geographical indications protecting intangible cultural heritage. Therefore, geographical indications model is not feasible to protect intangible cultural heritage. |
