| 摘 要： | 我国行政复议制度在保护行政相对人的合法权益，监督和保障行政机关依法行政，减轻法院讼累等方面，都发挥了重要的作用。但在行政复议机构独立性、行政复议和行政诉讼的衔接、行政复议审理模式方面仍有欠缺。我国应建立相对独立的公正的行政复议机构，统一复议和诉讼的法律适用、受案范围，改变以往单纯“书面审查为主”的审理模式，增设回避制度和听证程序等加以完善。

| Abstract: | Administrative Reconsideration （Administrative review） which is an important way to resolve administrative question plays important role in most countries＇ law system. 《The administrative reconsideration law of the People＇s Republic of China》that it established have played important role in protection of the legal rights and interests of administrative relative person, in supervisor and guarantee of the exercise of administrative functions according to law of administrative organs, and in alleviation of judicial lawsuit burden. However, it as a new system, there are still many shortcomings . in this thesis the author point out the defects of the Administrative Reconsideration system in our county and try to put forward some fragment. |
