| 摘 要： | 共同犯罪有"刑法学的迷路"之称,其复杂性不仅表现为多人共犯一罪,更表现为各个共同犯罪人在共同犯罪活动中所起的作用不同,共同犯罪出现的状态也不同于单独犯罪,因此引发对共同犯罪案件中的定罪和量刑等实践问题的思考,除了依据明确的法律条文规定之外,也要应用法律的精神和原则才能正确处理实践中遇到的问题。
