| 摘 要： | 目前我国婚前个人按揭贷款所购房屋，婚前取得产权，并以夫妻共同财产偿还的，离婚时对房屋归属、增值部分及共同偿还贷款行为如何认定、如何分割的问题，法律并无明确规定。各地高级人民法院针对本辖区的具体情况制定了一些规定，但各地规定并不统一，各法院最后的判决结果也不尽相同。本文仅就此类案件中有争议的部分进行分析。

| Abstract: | At present in China, mortgage room before marriage has the property,but returning the money after the marriage by the husband and wife, when divorcing, there is no clear stipulation about how to determine the ownership of the room, the valueadded part, and co-return-loan part and how to separate the room. According to the real conditions, each higher people＇s oourt made some rules in its jurisdiction, but the rules from various areas are not unified and various courts final ruling is also different. This article only makes brief analysis of several dispute places on this kind of case |
