| 摘 要： | 产权作为一种法权关系，是生产关系的法律表现形式，是一个历史范畴。中国特色的社会主义产权理论，是中国经济现代化建设过程中的产权理论，是在科学发展观指导下的科学产权观。中国特色社会主义产权构建过程是一个受产权理论文化影响的过程。它必然要吸取古典产权理论，现代产权理论，吸取改革开放的经验教训。产权的界定是一个动态博弈的演进过程，中国特色社会主义产权理论的构建过程是一个公有制产权与私有制产权的对立与统一、博弈与均衡的过程，是一个最终要达到效率与公平相统一的博弈过程。

| Abstract: | Property right,as a kind of right relationship,is the legal expression of production relations and a historical category.The socialist property right theory is a scientific property outlook guided by scientific development outlook in modern economic construction process of China.The process of property right establishment with Chinese socialist characteristic is influenced by the culture of property right theory.It should inevitably absorb the classical and modern property right theory,drawing experience and lesson from reform and opening-up.The definition of property right is an evolution process of dynamic game,and the property right theory establishment with Chinese socialist characteristic contains a process showing the unity of oppositeness in public and private ownership property right,game and balance,and the final unity of efficiency and fairness. |
