| 摘 要： | 自改革开放伊始,我国就非常注重运用多种工具推动改革进程,在各个领域的改革过程中形成了一系列行之有效的试验手段,其中就包括立法试验。对我国体育领域的立法试验实践进行全面的回顾检视,可以发现立法试验已经成为体育领域改革的重要手段之一,但是在试验主体、事项范围、试验程序等方面也存在问题。面向未来,体育领域的立法试验仍然有良好的发展前景。在观念变革的前提下,体育立法试验的主体和事项范围均有进一步扩展的空间,既需要充分运用现有制度,也需要体育主管部门进一步激发其他主体对体育改革的热情,并与之共同努力,从而实现立体化的体育立法试验体系。

| Abstract: | Since the beginning of the reform and opening up,China has attached great importance to the use of various experimental means to promote the reform process.In the process of reform in various fields,a series of effective experimental means have been formed,including legislation experiment.Through a comprehensive review of the practice of legislation experiment in the field of sports in China,we can find that legislation experiment has become one of the important means of reform in sports field,but there are still some problems in the subject,scope and procedure of the experiment.Facing the future,the legislation experiment in sports field still has a good development prospect.Under the premise of concept change,there is room for further expansion of the subject and scope of sports legislation experiment,which not only needs to make full use of the existing system,but also needs the sports authorities to further stimulate the enthusiasm of other subjects for sports reform,and work together with it to realize the three-dimensional sports legislation experimental system. |
